Federal Judge Orders Freedom of Abrego Garcia from Immigration Custody

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement lacks legal authority.

"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her ruling.

The case stems from a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling charges, he was detained in federal detention.

In her order, the judge noted that the government does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Background of the Case

The legal proceedings center on disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also pleaded not guilty to the smuggling charges, which are part of a separate trial in the state of Tennessee.

The court, who was overseeing his petition to deportation in a Maryland district court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
